A San Jose man was killed Thursday evening when the car he was riding in crashed on a mountain road at the Santa Clara-Santa Cruz county line, and the driver is suspected of DUI, the California Highway Patrol said.
According to early reports, two men were traveling north in a silver 2001 Volkswagen Golf on Highway 35, about a mile past Highway 9 west of Saratoga, when the car crossed into the oncoming lane, went off the road and hit a tree. The vehicle then went down an embankment and crashed into a fence.
The CHP said the passenger side of the car took the brunt of the initial impact, resulting in major injuries to the man in that seat. Both occupants of the vehicle were taken to the hospital, where the passenger died. His identity has not been released.
The driver, 30-year-old San Jose resident Edson R. Marin, suffered minor injuries and was later arrested on suspicion of DUI.
